What Is Civil Litigation?
The first element of understanding Civil Litigation is to understand the difference between Civil Law andCriminal Law. Civil law is basically anything that is not a Criminal Offense. A Criminal Offense typically involves the police, the prosecutor’s office, and the Commonwealth of Pennsylvania as one of the parties to the case. Criminal law would govern traffic offenses (speeding, failure to stop at a stop sign, turn signals), summary offenses (disorderly conduct), Misdemeanors (DUI’s), and Felonies (murder, grand larceny). The end result of a Criminal offense is jail, probation, or a fine.
Civil law, on the other hand, usually involves an individual or company suing another individual or company. Civil law includes Landlord/Tenant, Traffic Accidents, Breach of Contract, Employment,Negligence/Personal Injury, Small Claims, Estate Planning/Wills, Corporate Mergers, etc. When Civil law is involved, the end result is USUALLY some award for money.
Now, Civil Litigation is any civil case that requires me to go to Court. For example, you get in a car accident and want to sue the other drive for money = Civil Litigation.
How Do You Know If Your Case Involves Civil Litigation?
Generally speaking, unless your case involves you being arrested by the police or charged with a crime, you case is Civil in nature. Whether you case will go to Court depends on a number of factors. I would have to speak with you about your case in order to determine whether it requires litigation.
